Location of the boom truck collapse in Upper Manhattan5 construction workers were injured, including three seriously in a crane collapse that occurred in Upper Manhattan yesterday afternoon. The accident occurred around 2:30 pm at a construction site located at 3880 Ninth Avenue in Inwood. A crane attached to a small boom truck tragically collapsed, resulting in injuries to five construction workers.  3 of them suffered serious injuries. Investigation is ongoing with yesterday’s stormy conditions probably being a factor in the accident.  As crane accident lawyers deeply invested in the safety and rights of construction workers, this incident not only highlights the risks involved in such operations but also underscores the importance of stringent safety measures and legal recourse in the event of accidents.

gair-150x150-1Harriet  Gair who founded our personal injury law firm with her husband Harry Gair is among  several powerful women attorneys that are featured in the New York Women’s Bar Association (NYWBA) Legacy Project. The project is a series of short videos about NYWBA’s history.

The first set of these videos was presented last Thursday night at a reception and special screening. Our partner NYC Personal Injury Attorney Anthony Gair who is the son of Harriett and Harry Gair, spoke on behalf of his deceased mother in a video, was also present at the reception.

Legacy-Project-6651Harriett started to work for her late husband, the noted trial attorney Harry Gair at the age of 15.  She attended high school and college at night, earning her Bachelor degree in 1938. She was married to Harry Gair after that and then attended Law School and obtained her LLB in 1940. In 1945 she became a managing partner in the personal injury law firm of her husband which was thereafter named as “Gair & Gair”. Harriett managed the firm while her husband concentrated on achieving eminence in the court room as a trial attorney.

Injured in New YorkIn New York,  anyone who suffered injury or damages as a result of the negligence of someone else or of an entity can file a claim. In order to obtain compensation the victim will have to prove the liability of the person or entity responsible for the injury and the damages resulting from the negligence. These element constitute the basis of a personal injury case. Because they are sometimes difficult to evaluate, victims of personal injury, especially those who suffered catastrophic injury work with personal injury attorneys who will handle their claims so they can concentrate on their recovery.

In New York, the most common personal injury claims are auto accident claims. In New York City only, according to the most recent statistics, 15 people were killed and 4,105 people were injured in car accidents last March.  Among those killed were 8 pedestrians, 3 drivers and 4 passengers. Among those injured were 1782 drivers, 1289 passengers, 294 cyclists and 740 pedestrians. Crash injuries or death are most of the time caused by the negligence of another road user and therefore  victims of car accidents can often file a personal injury claim.

Premises liability claim are also quite common in New York City as anyone who suffers injury on the premises of a residential or commercial property that was caused by dangerous or defective conditions on the premises can potentially file a lawsuit. Falling debris from inadequately maintained buildings, faulty cellar doors or cellar grate, sidewalks not proprely maintained, defective elevator or escalator, electrical issues can all lead to accidents causing personal injury and sometimes death.

Gair-Gair_Tony-Gair_02Our partner Anthony Gair has carved out a reputation as one of the best product liability lawyers in NYC.  Yesterday he talked to CNBC journalist Lauren Thomas about the refusal by Peloton to comply with the Consumer Product Safety Commission and recall its high-end treadmill Tread+. 

Multiple children  and a pet have been injured and recently a child died in a Peloton Tread+ treadmill accidents but Peloton has been very reluctant to cooperate with the federal safety agency. The company is fighting a request to recall the dangerous product and refuses to provide the name of the child who recently died after getting stuck under the high end Peloton treadmill.

“The CPSC must have reason to believe that the treadmill wasn’t designed appropriately” said Anthony Gair.  According to him, Peloton might not have done a hazard analysis before launching the product or if they did, he questions if they knew about the danger and ignored it.

New York Child sexual abuse lawyer Ben RubinowitzThe COVID crisis has dramatically altered the way courts conduct business, but any judge will tell you, with a sense of pride, that the courts never closed. How have courts – an institution notoriously slow to change – adapted to provide access to justice throughout a pandemic?

Our managing partner Ben Rubinowitz will be speaking at a conference hosted by The Center on Civil Justice at NYU Law School that will address these issues. The conference will take place online Monday January 11, 2021, from 12pm to 5pm.

The conference will examine the nature of the way courts change and adapt in general, what specific trial and pre-trial rules and procedures have changed (and how), and which of these changes can be used to improve efficiency and access to justice after the COVID crisis passes.
