Lithium ion battery can be dangerousOur personal injury law firm is concerned about the recent news regarding lithium-ion batteries causing deadly fires in New York City. According to reports, a 64-year-old man died in a Bronx apartment fire caused by a defective lithium-ion battery over the weekend, and the FDNY has reported 33 fires caused by these batteries this year, resulting in three deaths and 42 injuries.

To address this issue, Mayor Eric Adams signed  five bills into law aimed at preventing fires caused by lithium-ion batteries in New York City (see our previous blog about these bills related to e-bike battery safety). 

While the bills only address lithium battery safety in New York City, there is a need for federal legislation to ensure that batteries are safely manufactured and used. Currently, compliance with safety standards is voluntary, and the wide availability of uncertified or after-market tampered batteries is contributing to the problem. Additionally, a change in federal law in 2016 exempts imports below $800 from inspection and tariffs, which has made it easier for uncertified or unsafe batteries to enter the market.

NY Top Verdicts Personal Injury 2017
The New York Personal Injury Lawyers at Gair, Gair, Conason, Rubinowitz, Bloom Hershenhorn, Steigman and Mackauf obtained the second and the third highest personal injury verdicts in New York in 2017.

  • On September 28 2017, Ben Rubinowitz, Rachel Jacobs and James Rubinowitz obtained a $71 million verdict for a 19 year old woman who suffered a fracture of her lumbar spine in a car accident. This is the second highest personal injury verdict and the highest car accident verdict in New York in 2017. It is the fourth of all New York verdicts among all categories of law (read more here)
  • Less than a month later, on October 24 2017, Ben Rubinowitz and Peter Saghir obtained a $41.5 million verdict for a 43 year old sanitation worker who was fatally struck by a street sweeper.  This is the thirdd highest personal injury verdict and the highest truck accident verdict in New York in 2017. It is the fifth of all New York verdicts among all categories of law (read more here)

New York Wrongful death Attorneys Ben Rubinowitz and Peter SaghirOur New York Personal Injury Attorneys Ben Rubinowitz and Peter Saghir  recently obtained a $41.5 million Verdict for the wrongful death of a City sanitation worker who was struck by a sweeper truck.
43-year-old Steven Frosh, a City worker died on the job in 2014. He left behind a wife and 4 children aged 7 weeks, 3, 8 and 11 year-old. At the time of the accident, Mr. Frosh was in a city garage in Maspeth. He was making adjustments to his street sweeper truck when he was fatally hit by another street sweeper. He suffered excruciating pain for 2 to 3 minutes before succumbing to his injuries.
His wife, Bina Frosch, sued the City of New York for the negligence and carelessness of the worker driving the sweeper truck.
