Legal Liability After 1-Year-Old Child Is Killed and his nanny injured in Queens Pedestrian Accident Involving Alleged Impaired Driver

location of the fatal queens drunk driving accidentA fatal pedestrian collision in Flushing, Queens, involving a 1-year-old child raises significant legal issues concerning driver negligence, pedestrian right-of-way, impaired driving, and potential wrongful death liability under New York law.

According to the Queens District Attorney’s Office, the collision occurred on October 11, 2026, at the intersection of Murray Street and 32nd Avenue. Prosecutors allege that 57-year-old Elvin Rivera was operating a Chevrolet Silverado northbound on Murray Street when he failed to properly stop at a stop sign, entered the intersection, and struck a stroller carrying 1-year-old Justin Hu.

The child was transported to a hospital, where he was pronounced dead. His nanny, who was pushing the stroller, reportedly sustained an injury to her arm.

The allegations in this case illustrate several issues that may arise in a civil action following a fatal Queens car accident, including whether the motorist violated traffic laws, failed to yield to pedestrians, operated the vehicle while impaired, or otherwise failed to exercise reasonable care.

Alleged Failure to Yield and Driver Negligence

New York drivers have a duty to operate their vehicles with reasonable care and to obey traffic-control devices, including stop signs. Drivers must also exercise appropriate caution when approaching intersections and areas where pedestrians may lawfully be crossing.

Prosecutors allege that the child and his nanny were within a marked crosswalk and had the right of way when they were struck.

In a civil case arising from a pedestrian accident, evidence that a driver failed to stop, failed to yield, entered an intersection unsafely, or failed to maintain a proper lookout may be relevant to determining negligence and liability.

The precise circumstances of the collision would ordinarily be evaluated through evidence such as police reports, surveillance footage, witness testimony, vehicle data, photographs of the scene, and, when appropriate, accident reconstruction analysis.

Drug or Alcohol Impairment May Be Relevant to Civil Liability

The Queens District Attorney’s Office has alleged that Rivera failed a field sobriety test and tested positive for cocaine and THC following the collision.

He has been charged with offenses including second-degree manslaughter, second-degree vehicular manslaughter, assault, reckless driving, and offenses relating to driving while impaired. These charges are allegations, and the defendant is presumed innocent unless proven guilty.

In a separate civil case, evidence that a motorist was impaired by alcohol or drugs may be highly relevant to the issue of negligence. Victims of crashes involving intoxicated or drug-impaired motorists may have the right to pursue compensation through a civil claim regardless of the outcome of the criminal prosecution.

Our attorneys represent individuals and families injured in drunk driving and impaired driving accidents throughout New York.

Criminal Prosecution and Civil Liability Are Separate

A criminal prosecution and a civil personal injury or wrongful death action are separate proceedings with different purposes and legal standards.

The criminal case is brought by the government to determine whether the accused committed a criminal offense. A civil claim is brought to establish liability and obtain compensation for injuries or losses caused by another party’s negligence or wrongful conduct.

Accordingly, the existence of a criminal prosecution does not prevent the injured parties or the family of a deceased victim from separately investigating and pursuing their civil remedies.

Evidence developed in connection with a criminal investigation may also become important in the civil case, including toxicology results, witness statements, surveillance footage, vehicle inspections, and evidence concerning the driver’s conduct immediately before the collision.

Wrongful Death Claims Following a Fatal Pedestrian Accident

When a pedestrian is killed because of another person’s negligence, the decedent’s personal representative may be able to bring a New York wrongful death claim.

Under New York law, a wrongful death action may seek recovery for legally recognized economic losses suffered by the decedent’s beneficiaries, as well as certain medical expenses and funeral expenses associated with the death.

Depending upon the circumstances, the estate may also have a separate survival claim for damages sustained by the decedent before death, including conscious pain and suffering where supported by the evidence.

Wrongful death cases involving young children present particularly complex issues concerning damages and require careful legal and factual analysis.

Preserving Evidence After a Serious Queens Auto Accident

Prompt investigation can be especially important after a serious or fatal motor vehicle collision.

Relevant evidence may include:

  • Surveillance and traffic-camera footage
  • Police and accident reports
  • Photographs and measurements from the collision scene
  • Vehicle event data
  • Toxicology evidence
  • Cell phone records where distracted driving is suspected
  • Witness statements
  • Driver licensing and driving-history records
  • Vehicle inspection and maintenance records

Some forms of evidence, particularly private surveillance video, may be lost or overwritten if preservation efforts are not undertaken promptly.
