New York Personal Injury Attorneys Rubinowitz and TorganIn their latest Trial Advocacy Column in the New York Law Journal, Top New York Personal Injury Attorneys Ben Rubinowitz and Evan Torgan write: To be effective with cross-examination, the trial attorney must know what her objective is and how to get there. All crosses must start at the end—with what attorney intends to prove. Once the attorney knows what she intends to prove, she can use different techniques such as changing the tone of her voice, focusing the question for the witness, asking low risk open ended questions and making statements with a question at the end.

New York Personal Injury Attorneys Ben Rubinowitz and Peter SaghirWe are pleased to announce that our partners, NYC Personal Injury Lawyers Ben Rubinowitz and Peter Saghir have obtained a record setting settlement on behalf of four young boys who were sexually abused by a worker at a local catholic church in Brooklyn.  The Diocese of Brooklyn and Queens and a local after school program will pay $27,500,000 which will be divided evenly with each boy receiving $6,875,000.  This is the largest settlement in the country paid by the Catholic Church to an individual survivor of sexual abuse.

Between 2003 and 2009, Angelo Serrano, sexually abused the four young boys who were between the ages of 8 and 12.  Serrano who was 58 years old at the time of his arrest in 2009 was a long time worker at St. Lucy’s St. Patrick’s, a Catholic church in the Clinton Hill section of Brooklyn.  Serrano served as a CCD teacher at the church and also as the Director of Religious Education.  The abuse which took place over a number of years was perpetrated inside the church and in his apartment which was located in the old school house of the church.

It was revealed during depositions that the priests in the church knew or certainly should have known that Serrano was sexually abusing children.  One priest testified that he witnessed Serrano inappropriately embrace and kiss an eight or nine year old boy on the mouth in the church office.  Despite witnessing this behavior the priest did not report this conduct, document it or even ask the child his name.

New York Personal Injury Lawyer Howard HershenhornNew York Personal Injury Attorney Christopher DonadioOur partner, NYC Personal Injury Attorney Howard Hershenhorn assisted by Christopher Donadio is representing Kyle Green in a lawsuit against rapper Travis Scott and the New York concert venue Terminal 5. 23-year-old Kyle Green was left paralyzed after he fell from a balcony during Travis Scott’s concert on April 30 at Terminal 5 in New York.

Travis Scott concerts are infamously known to be wild and the singer himself  encourages fans to stage dive and surf the crowd. During the New York concert before Green was pushed from the third floor balcony, Scott put the spot light on a fan who was attending the concert from the first floor balcony and encouraged him to jump which the fan did. He said to the fan, “They going to  catch you, don’t be scared.” (see video below). Other fans then did the same.  Shortly after, Green who was watching the concert from the third floor balcony was pushed over the railing by the surging crowd. He fell and hit the floor. Security guards immediately surrounded him and Travis yelled at them to bring the fan to the stage. Green who was in tremendous pain was lifted up, pulled around and dropped in front of the stage without using any backboard or neck brace. Then Scott gave him his ring.

Kyle Green is now in a wheelchair. He suffered serious injury that includes fractured vertebrae, a broken left wrist and fractured right ankle.  The injuries required surgery and he was left paralyzed on his left side and must get around in a wheelchair. He had to quit school and move out of his Brooklyn apartment to go live with his parents in Dutchess County.

New York Personal Injury Attorneys Rubinowitz and TorganIn their Trial Advocacy Column in the New York Law Journal, NYC Personal Injury Attorneys Ben Rubinowitz and Evan Torgan write: “From a procedural point of view, the real goal of jury selection for the trial attorney is to preserve peremptory challenges. In civil cases in New York each side is allowed only three peremptory challenges; however, each side is allowed an unlimited number of challenges for “cause.”  This article was written in light of the recent political commentary on immigrant status. It is essential that the trial lawyer confront these issues directly or risk an adverse verdict. Unfortunately, certain political speeches have had the effect of improperly targeting immigrants. This article was written to assist Trial Lawyers to overcome such bias and bigotry.
