New York Personal Injury Attorneys Ben Rubinowitz and Peter SaghirWe are pleased to announce that our partners, NYC Personal Injury Lawyers Ben Rubinowitz and Peter Saghir have obtained a record setting settlement on behalf of four young boys who were sexually abused by a worker at a local catholic church in Brooklyn.  The Diocese of Brooklyn and Queens and a local after school program will pay $27,500,000 which will be divided evenly with each boy receiving $6,875,000.  This is the largest settlement in the country paid by the Catholic Church to an individual survivor of sexual abuse.

Between 2003 and 2009, Angelo Serrano, sexually abused the four young boys who were between the ages of 8 and 12.  Serrano who was 58 years old at the time of his arrest in 2009 was a long time worker at St. Lucy’s St. Patrick’s, a Catholic church in the Clinton Hill section of Brooklyn.  Serrano served as a CCD teacher at the church and also as the Director of Religious Education.  The abuse which took place over a number of years was perpetrated inside the church and in his apartment which was located in the old school house of the church.

It was revealed during depositions that the priests in the church knew or certainly should have known that Serrano was sexually abusing children.  One priest testified that he witnessed Serrano inappropriately embrace and kiss an eight or nine year old boy on the mouth in the church office.  Despite witnessing this behavior the priest did not report this conduct, document it or even ask the child his name.

In the first part of the program, Mark Mandell from Mandell Shwartz & Boisclair in Providence, RI will introduce the concept of Case Framing to participants. In the second part, Ben Rubinowitz will explain how to Create Echoes by developing, reinforcing and  successfully presenting your theory of the case to the trier of facts.

The Seminar will take place at the Hilton Meadowlands in East Rutherford, NJ from 11:00 am to 5:00 pm. It is restricted to regular members of the NJAJ.

The Verdict was also one of the top 5 in New York. Ben obtained a $71,000,000 Verdict in Wang v. Sexton in New York Supreme Court, New York County. The case was tried before Supreme Court Judge James d’Auguste. After 3 weeks of trial, the Manhattan Jury awarded Ms. Wang a stunning amount of money to fully and fairly compensate her for injuries suffered in a car accident in New York in August of 2012. New York Medical Malpractice Lawyer Ben RubinowitzOur managing partner Ben Rubinowitz has been asked by the National Institute for Trial Advocacy to join a group of experts throughout the country to teach lawyers to become Child Advocate Attorneys. The program, sponsored by Facebook, Baker McKenzie and NITA, will teach Corporate in-house and Public Interest Advocates how to represent vulnerable youth in children’s cases involving immigration, child welfare, juvenile justice, education and substance abuse cases. “More than ever these children need good, solid representation,” said Ben Rubinowitz “especially with what is going on with the unfortunate child separation policy recently enacted by our government. Clearly, these children have no idea how to navigate their way through the legal system and can suffer life long injuries if not represented properly. I am honored to be a part of this program.” Rubinowitz, who is donating his time, explained, “These lawyers are truly champions of children”s rights. They will make a difference. I applaud the efforts of Facebook in donating their facility and all the lawyers who are so generously giving their time to help children in their time of need. Some of these children have had their lives turned upside down, some have been forced into prostitution, some have become drug users and many are just too afraid to speak up. This is why advocates are needed.” The program will be held at Facebook’s Menlo Park facility in California from August 21 through August 24, 2018.

Our Partner, New York Personal Injury Lawyer Ben Rubinowitz, was asked to lecture and share his experience with Supreme Court Judges at the New York State Judicial Institute. Each year the Judicial Institute provides seminars for sitting Supreme Court Judges. This year Ben was asked to provide insight on Medical Malpractice cases and recent updates on central issues in the field. Joining Ben as a featured expert are the Hon. George Silver, Elizabeth Cornacchio , Charles Bach and Jeff Korek.

Through our clients’ lives we see the unimaginable: pain on parents’ faces as they struggle to accept that their child is dead; pain on a child’s face when the child realizes that their Mom or Dad will not be coming home; someone trying to learn to walk again after suffering a devastating spinal cord injury; spouses realizing that their partner in life is not the same after suffering a life changing injury.  At our firm we work tirelessly to right these wrongs that result in families being torn apart.  Our work is motivated by the fact that every day we witness firsthand what happens to families when a loved one is injured or lost.  We know our clients would do anything to make their families whole again. Donadio has been invited to lecture at a joint American Board of Trial Advocates and Defense Association of New York continuing legal education event titled “Frye Hearings and the Effective Use of Biomechanical Experts” which will be held on Wednesday, May 30, 2018 at 5:30pm at Battery Gardens at 1 Battery Park, New York, New York. Mr. Donadio has been asked to provide a plaintiff’s attorneys perspective to the current trends in Frye hearings involving biomechanical experts.

A Frye hearing involves a hearing in front of a judge, where the judge is asked to determine whether an expert witness is permitted to testimony. The “Frye hearing” was established by the Federal District of Columbia Circuit court in Frye v. United States, 293 F. 1013 (D.C. Cir. 1923). “[T]he Frye test asks ‘whether the accepted techniques, when properly performed, generate results accepted as reliable within the scientific community generally.” Parker v. Mobil Oil Corp., 7 N.Y.3d 434, 446, 857 N.E.2d 1114 (2006), citing People v. Wesley, 83 N.Y.2d 417, 422, 633 N.E.2d 451 (1994).

Biomechanical experts are experts that are typically hired by defendants in motor vehicle collision cases who claim that an injured party could not have been injured by the collision due to the physics involved in the crash. Although biomechanical science has been generally recognized by the courts of New York as a science that generates results that are accepted as reliable within the scientific community, it does not mean that each and every biomechanical expert is offering testimony that is based on methods that truly are accepted.
