An elderly pedestrian died after being struck by a taxi on The Upper West Side of Manhattan, NYC early Sunday morning. 88 year old Luisa Rosario, a beloved neighborhood figure, was starting to cross 109 street with the light and had the right of way when a taxi which turned right onto 109th Street from Columbus Ave hit her. The taxi driver, 73 year old Salifu Abubkar,  said he didn’t see the victim. He also told the police that he had been working non-stop for 16 hours.  He was charged with failure to yield.

Taxi drivers are prohibited by the Taxi and Limousine Commission to drive more than 12 hours straight and if they do so they may be issued a summons by the Commission.

Salifu Abubkar has been driving a cab for 30 years and had never had any serious accidents. Taxi drivers don’t have retirement pensions therefore if they don’t have any other source of income they are forced to continue to work.  Read more in the NY Daily News

An 86 year old woman died after being struck by a car in Manhattan last Friday around 5:00 pm. The woman was crossing West End Ave near 64th Street on the Upper West Side when she was struck by a car. The driver remained at the scene of the accident while the victim was transported to the Hospital. The police are still investigating the accident.

The elderly woman was the 9th pedestrian to be killed last week in a car accident. Read more in the Gothamist

3 pedestrians died and 3 others suffered personal injury in a car accident in New York City last Saturday during Halloween celebrations. 10 year old Nyanna Aquil and her 65 year old grandfather Louis Perez  as well as 24 year old Christian Leka died after 52 year old Howard Hunger lost control of his vehicle, jumped the curb  and slammed into trick-or-treaters walking along Morris Park Ave near Bogart Ave. According to the preliminary police investigation, the car driver appeared to have suffered a seizure while he was driving. As he was driving west on Morris Park Ave he struck a car in front of him twice before driving into oncoming traffic and jumping the curb. He is still in the hospital recovering from his injuries.

Louis Perez was walking with her granddaughter Nyanna and her two young sisters and Christian Leka in the company of her fiancee was holding his 9 year old sister’s hand when the car crashed into the two groups of trick-or-treaters.  Leka shoved her fiancee to the ground and pushed his sister away saving their lives. One of Nyanna sisters as well as Christian Leka’s sister and his fiancee were injured and hospitalized.

So far this year  13 pedestrians were killed by a car jumping a curb in New York City.

Nupur BatenA man who was backing out of his driveway in Brooklyn, NYC, fatally struck his wife as she was trying to guide him.  Sakwat Hossain who just got his New York City driving license 3 months ago lost control of his vehicle as he was backing out of the family house driveway on E. 32nd Street near Avenue D in Flatbush, Brooklyn. He hit his 26 year old wife, Nupur Baten who got pinned against the wall of the adjacent appartment building. She was rushed to the hospital but she didn’t survive. She leaves a 4 year old and a 10 month old behind. Read More in the NY Daily News

Our New York Personal Injury Lawyers represented a woman who was also accidentally run over by her husband. He was backing up to pick her up and did not realize she was standing in the street. She suffered serious spinal injuries. Fortunately the husband had purchased an endorsement in his insurance policy specifically stating that interspousal liability was covered by the policy. In New York if this is not explicitly included in the policy interspousal accidents will not be covered. Too many people do not understand this and do not purchase the endorsement.

Last May, 34 year old Marino Nunez, a father of two,  died after being struck by 44 year old Jorge Heraiz, a retired NYPD cop who was drunk driving. That night Hernaiz drank a bottle of vodka and a bottle of Colt 45 before driving. He is accused of fatally striking Nunez with his car as he was exiting the Henry Hudson Parkway onto W. 254th Street and Broadway in Riverdale, Bronx, NYC. After the accident happened, witnesses who saw Hernaiz trying to remove Nunez’s body from under his car called 911. The ex cop pleaded not guilty to drunkenly causing the pedestrian’s death. He is facing a maximum sentence of 25 years if he is convicted of aggravated vehicular homicide. Read more in the NY Daily News

An 81 year old woman was in critical condition after she was hit by an unlicensed 36 year old driver yesterday night in New York City. The accident happened at the intersection of Targee St. and Narrow Rd in Staten Island. The elderly woman was crossing the road when the driver struck her. The driver was issued a summons for unlicensed operation of a vehicle. This accident is the third serious pedestrian accident in Staten Island, NYC,  this month.

teen driverRecent statistics show that 41% of teen drivers who died in car accidents were intoxicated. While drunk driving has been declining, driving while impaired by other substances such as  weed, other illegal drugs, prescription and OTC medication has increased significantly. The National Teen Driver Safety Week that will kick off on October 18th will focus on this particular issue. The National Highway Traffic Safety Administration in association with the Center for Injury Research and Prevention at The Children’s Hospital of Philadelphia has developed material for schools and for parents to increase teen awareness about impaired driving.  Under the theme “Avoid the Regret – Avoid Impaired Driving” the campaign is seeking solutions to prevent teens deaths and injuries on the road.

2 pedestrians suffered personal injury in a New York City car accident this morning. Two men in their 40’s were walking near 18th Ave and 47th street in Borough Park, Brooklyn when a car jumped the curb and hit them early this morning. According to the police the driver fell asleep behind the wheel.

For the last few months in New York City there were more than 50 monthly traffic accidents caused by drivers falling asleep. According to NYPD statistics, these types of accidents have been steadily increasing in the city since the beginning of 2013. Until April 14 they would be below 50 most of the time.

A young man who was crossing the road mid-block suffered critical personal injury   after being struck by a car in Brooklyn, NYC. The accident happened as the pedestrian was crossing at Third Ave near 22nd street in Sunset Park with another man. The driver said that he saw them but he couldn’t get out of his lane to avoid them. A pedestrian died after being struck by a SUV while he was trying to cross the Long Island Expressway around 12:15 am Yesterday in Queens, NYC. According the the NY Daily News, the pedestrian was a homeless man in his 60s who was just wearing a shirt and underwear. He was rushed to the hospital but couldn’t be saved.

A few hours later on the Upper East Side of Manhattan another pedestrian was injured after being struck by a car near the intersection of 80th street and Madison. He was transported to the hospital. He is expected to survive.
