10th ave and west 42nd streetA pedestrian was injured after being ran over by a NYPD tow truck last Thursday around noon at the intersection of 42nd Street and 10th Ave. The elderly man was walking with a cane in the middle of the crosswalk on 42nd street when he was run over by a NYPD tow truck that was making a left turn from 10th Avenue onto 42nd Street. The pedestrian had the green light.

According to witnesses, the driver of the tow truck wasn’t paying attention to the road and didn’t yield to pedestrians. She made a very sharp turn while there were still people in the crosswalk and she didn’t even realize that she hit someone. A witness told the Gothamist “she was driving like crazy”.

After pedestrians screamed at her, the tow truck driver stopped near the scene of the accident but never left the truck to check on the unconscious man. She remained inside the truck while she was questioned by traffic supervisors.

In the second part, Ben Rubinowitz will explain how to Create Echoes by developing, reinforcing and  successfully presenting your theory of the case to the trier of facts.

Each year the Judicial Institute provides seminars for sitting Supreme Court Judges. Donadio has been invited to lecture at the New Jersey Association for Justice’s annual Boardwalk Seminar, on Wednesday, May 9, 2018 at 12 p.m. at Harrah’s Resort in Atlantic City, NJ. Mr. Donadio’s lecture, entitled “Helping the Jury Understand Damages,” will be a part of “The Medicine for Lawyers: the Missing Damages” continuing legal education program.

Too often, jurors fail to fully appreciate the harm that injured plaintiffs have suffered because they equate what has happened to the plaintiff to their own, less severe experiences.  As a trial lawyer it is imperative to ensure that the jurors consider what has occurred specifically to the injured plaintiff and not anyone else. This lecture will teach various techniques on how to educate the jury on the relevant anatomy, how to provide extreme detailed descriptions of the injuries, how to creatively use diagnostic films, and how to use detail intensive medical illustrations, to focus the jury on the harm suffered by the plaintiff, and prevent the jury from deciding damages based on their own experiences. The lecture will provide examples of these techniques from recent trials.
