Our partner, NYC Personal Injury Attorney Howard Hershenhorn and his team including Christopher Donadio and Anthony Gair have filed notices of claim against the City of New York, the Hudson River Park Trust and the State of New York for more than $600 million on behalf of 20 individuals who were either fatally struck or injured during the terror attack that occurred on October 31, 2017. The attack occurred on the Hudson River Greenway, a popular Manhattan bike path along the Hudson River.  Our personal injury law firm represents the families of 7 of the 8 bicyclists who were killed by the terrorist, as well as 13 individuals who were injured. Our clients include families and individuals from Argentina, Belgium and New York.

Our New York personal injury lawyers believe that authorities failed to “to implement measures and precautions to prevent vehicles from intentionally entering the bicycle path despite the fact that it was foreseeable”. It was foreseeable, based on various prior incidents, including the death of Eric Ng who was killed by a driver on the same bike path in 2006.  In addition, following Mr. Ng’s death, multiple studies have shown that necessary precautions were needed to prevent motor vehicles from driving on the Hudson River Greenway bike path. Also, for the past ten years, safety advocates have been asking for the installations of steel bollards and other safety measures to prevent cars and other motor vehicles from driving on the bike lane. The City of New York, Hudson River Park Trust and State of New York were presented with detailed plans to prevent collisions between cars and cyclists on the bike path. Unfortunately, no action was taken.

In 2010, the Department of Homeland Security, in light of concerns that terrorist groups using vehicles to ram innocent people, issued a warning to the City of New York and State of New York about the need to secure public pedestrian and public bicycle areas from motor vehicles. Again, despite this warning, no action was taken.

The program will take place from December 11th to December 13th 2017 at the NITA Education Center in Boulder Colorado. Attendees will receive 23 CLE credits for their participation in this program.

The “learning by doing” method used during NITA programs ensures that every participant will learn and master amazing new skills such as how to use memory muscle to formulate great questions on the spot or how to think quickly and effectively inside the Courtroom.

43-year-old Steven Frosh, a City worker died on the job in 2014. He left behind a wife and 4 children aged 7 weeks, 3, 8 and 11 year-old. At the time of the accident, Mr. Frosh was in a city garage in Maspeth. He was making adjustments to his street sweeper truck when he was fatally hit by another street sweeper. He suffered excruciating pain for 2 to 3 minutes before succumbing to his injuries.
His wife, Bina Frosch, sued the City of New York for the negligence and carelessness of the worker driving the sweeper truck.

Morgan Wang suffered Spinal Injury in a NY Car AccidentBen Rubinowitz, managing partner at Gair, Gair, Conason, Rubinowitz, Bloom, Hershenhorn, Steigman & Mackauf just obtained one of the largest verdicts ever in the Country for a Spinal Injury case. The Plaintiff, Morgan Wang, was awarded $71 Million by a Manhattan Jury last Thursday.

The case was tried before Supreme Court Judge James d’Auguste. After 3 weeks of trial, the Manhattan Jury awarded Ms. Wang a stunning amount of money to fully and fairly compensate her for injuries suffered in a car accident in New York in August of 2012. The jury awarded $5 million for her Past Pain and Suffering, 6 Million for her Future Pain and Suffering and 60 Million for her medical needs over her lifetime. “We put in an incredible amount of time and effort to make sure Morgan received Justice” said Ben Rubinowitz, who represented Morgan at trial, noting that “this young girl suffered life changing injuries.” She came to the right law firm. “We have a tremendous amount of expertise with Spinal Cord Injuries and no one will work harder or prepare for trialthe car after the accident better than us” said Rubinowitz.

The jury of 3 men and 3 women took two days to reach their verdict. Morgan suffered a fracture of her Lumbar Spine, often referred to as a broken back. Although she is now able to walk with braces, she still suffers from Neurogenic Bowel, a condition that makes it difficult for her to move her bowels.  As a result she will need continued medical and psychiatric care for the rest of her life. “Morgan is an amazing young woman” said Rubinowitz. “She refused to listen to her doctors at the trauma center who said she would never walk again. She overcame tremendous obstacles and worked through her pain at Mt Sinai Rehabilitation Center in Manhattan to learn to walk again. She is the epitome of someone who will never give up. I am proud of Morgan. She cares deeply about people and, to show you how remarkable she is, she now donates her time to help injured veterans. It was an honor to represent Morgan.”

Two people were critically injured in a car crash in New York early Wednesday morning. A reckless driver who was speeding north on Third Avenue blew a red light and crashed into a tractor trailer truck belonging to the New York City Department of Transportation. The impact was so strong that a taxi parked nearby was also hit and damaged. The taxi driver suffered serious injury and was taken to the hospital.  The driver and the passenger of the speeding car suffered critical injury. Their car was completely mangled and the FDNY had to cut the top of the car off to extricate them. They were rushed to the hospital. The driver is now in stable condition but the passenger is still clinging to his life. The truck driver wasn’t injured according to the police. Read more in the NY Daily News

Saghir, recently obtained a verdict of 100% liability against a glass company that dropped a large glass panel on a woman’s foot as she walked on the sidewalk. On September 29, 2012, Manhisha Narwani, 28, was walking with friends on 9th Avenue at 50th Street when two workers who were replacing a glass storefront dropped a large glass panel on her left foot causing her to sustain three metatarsal fractures. She underwent surgery on two of the metatarsals and subsequent physical therapy. The glass company blamed Manisha for the happening of the accident and for failing to see the glass as it was being carried on the sidewalk. After a 5 day jury trial in New York County before Hon. Arthur F. Enforon, the jury found Manisha was free from fault and that the glass company and workers were 100% at fault for the happening of the incident. The jury awarded Manisha $300,000 for past pain and suffering and $150,000 for future pain and suffering. The top offer by the insurance company was 250,000.
