Donadio obtained a $5 million settlement during trial involving a pedestrian injured in a van accident that occurred in Manhattan.

The case involved a New York City Department of Transportation van that struck and ran over the plaintiff on February 15, 2013 at the intersection of 6th Avenue and 31st Street in Manhattan.  The plaintiff, Hui Sang Park, was a college student on her way to class when she was hit by the van within the crosswalk. Following the collision, the driver of the van, city employee Richard Brooms, admitted to police officers at the scene that he never saw Ms. Park before he struck her and that he had no idea where she came from.

Ms. Park was taken from the scene by ambulance to New York Presbyterian Hospital. At the hospital, she was diagnosed with severe injuries including a comminuted open fracture of the tibia and fibula, a tibial plateau fracture, pelvic fractures, a sacral fracture, a right wrist fracture and a fracture to her shoulder. In addition to her fractures, while in the hospital, Ms. Park developed compartment syndrome in her lower leg, requiring an emergency fasciotomy. In addition to the fasciotomy, Ms. Park underwent multiple surgeries, which required the insertion of hardware in her leg, knee, pelvis and wrist.

brOn Wednesday our Partner, Ben Rubinowitz, lectured to more than 60 Assistant District Attorneys from the Nassau County District Attorneys office. Ben was asked to teach Cross Examination skills to the ADA’s based on his experience and success in the Courtroom. “I felt honored to be asked to teach cross examination skills to the ADA’s. I started out as a prosecutor and know first hand the challenges that these ADA’s face each day. I have used those same skills that I learned as an Assistant DA to prosecute those who cause injury or death to our clients.” In his lecture, Ben stressed the importance of focusing on every aspect of trial with an eye toward strengthening the argument for summation. He stressed the importance of presenting a fair and honest case, methods of dealing with non-responsive witnesses and how to dissect a witness who tells less than the truth. Following Ben’s presentation the Director of Training commented that the Assistants enjoyed the presentation so much that they immediately requested an additional presentation by Ben.

brOur managing partner, NY personal injury attorney Ben Rubinowitz will be the featured speaker at the Massachusetts Academy of Trial Attorneys; Attorney Voir Dire Skills Development Workshop this coming Thursday, June 9th. The workshop will take place at the Hampshire County Courthouse, Courtroom 3, 15 Gothic Street, Northampton, MA.  from 1:00 pm to 4:00pm.

The seminar will start with an introduction from MATA President Annette Gonthier-Kiely, followed by lectures.  A voir dire demonstration will then be conducted with an actual simulated jury followed by 4 pre-selected volunteers who will have the opportunity to test-drive their own voir dire skills by conducting a progressive panel voir dire.

Personal injury attorneys representing construction workers that have been injured at work understand too well the economic consequences of such accidents. When a worker is injured he will not only have direct costs such as medical expenses but also indirect ones such as lost wages and fringe benefits as well as lost home productivity.

A recent study published by the American Journal of Industrial Medicine provides an analysis of the economic consequences of workplace injuries in the United States.  The authors of the study , Xiuwen Sue Dong DrPH1,*, Xuanwen Wang PhD1, Julie A. Largay MPHand Rosemary Sokas MD, MOH2   estimated that in 2007, the total of the direct and indirect costs of all reported work injuries in the US cost $250 billion, higher than the $219 million spent on cancer. Worker’s compensation covers an average 44.5% of the direct medical costs but this amount represents only 20.7% of the total costs. The difference is being  shifted onto the workers and their families, insurance carriers and the government.

The study finds that following an injury, an injured worker’s family will suffer income loss because of the lost wages and his or her disability. The study also shows that Union workers are better protected in case of an accident and will suffer a moderate income loss compared to a non union worker who suffers the same work injury. Income disparity will persist in the long term.

New York personal injury attorney Stuart Schlesinger won $875,000 in a medical malpractice lawsuit for a client but the client never saw the money. Margaret Last, a a former executive assistant turned to attorney Stuart Schlesinger after a treatment from a podiatrist left her in so much pain that she had to start using a wheelchair or a cane to get around. She was relieved after Stuart Schlesinger was able to win $875,000 in a medical malpractice lawsuit against the podiatrist. However a year after, Margaret Last still hasn’t received any of her money according to a lawsuit that she filed against Schlesinger.

It is not the first time that Schlesinger has committed legal malpractice. He was arrested in December for defrauding clients of over $3 Million dollars in settlement proceeds.

The conduct of this NYC personal injury attorney is a disgrace to our entire profession. This is exactly what a lawyer should not be. Most of the lawyers who practice in the personal injury field, as we do, put their clients interest first and work to serve their needs. The fact that a lawyer could steal a seriously injured person’s money is unacceptable. The harshest possible sentence should be handed down against Stuart Schlesinger because he broke the most basic bond of trust between lawyer and client.

Nupur BatenA man who was backing out of his driveway in Brooklyn, NYC, fatally struck his wife as she was trying to guide him.  Sakwat Hossain who just got his New York City driving license 3 months ago lost control of his vehicle as he was backing out of the family house driveway on E. 32nd Street near Avenue D in Flatbush, Brooklyn. He hit his 26 year old wife, Nupur Baten who got pinned against the wall of the adjacent appartment building. She was rushed to the hospital but she didn’t survive. She leaves a 4 year old and a 10 month old behind. Read More in the NY Daily News

Our New York Personal Injury Lawyers represented a woman who was also accidentally run over by her husband. He was backing up to pick her up and did not realize she was standing in the street. She suffered serious spinal injuries. Fortunately the husband had purchased an endorsement in his insurance policy specifically stating that interspousal liability was covered by the policy. In New York if this is not explicitly included in the policy interspousal accidents will not be covered. Too many people do not understand this and do not purchase the endorsement.
