Following the tragic death of  architect Erica Tishman who was killed by falling debris in Times Square, New York two days ago, Inside Edition looked at previous cases of victims struck by falling debris.

They talked to our client Jayson Greene who lost his 2 year old daughter Greta after a brick fell on her. At the time of the accident, Greta was sitting on her grandmother’s lap on a bench in the Upper West Side of Manhattan (see more info in previous blog). Jason  told Inside Edition that no one in New York City should fear for their life when walking in the street. He felt very sad for the family of Erica Tishman who will have to endure the same tragedy his family went through when his daughter was killed.

location of the bicycle and dump truck accidentA 25 year old cyclist was killed by a garbage truck in New York early Sunday morning. Matt Travis is the 28th person to die in a bicycle accident in New York City this year. Matt was riding South on the Willis Ave Bridge bike path when a dump truck made an illegal U-turn to get on the bridge from a service road (technically 1st Avenue, see map) and fatally struck him. The driver then fled the scene of the accident. The police indicated that they are looking for him but they haven’t released any information yet.

Matt was found by the police lying on the street with severe trauma. He was rushed to the hospital where he was pronounced dead.

Matt Travis was a rising star pro wrestler and a student at the House of Glorty Wrestling School in Queens. He was recently interviewed by Vice magazine about his passion. Friends and fans have been posting tributes to the young man on social media and at the location of the accident.

Donna Strum was fatally struck by a cyclistOn April 24th, 41 year old Dameon Doward was riding his bike on 57th Street.  He ran a red light at the mid-block traffic signal between Fifth and Sixth Ave and struck Donna Sturm who was crossing the street in the crosswalk after the light turned green for pedestrians. Sturm died two week later from her injuries. Daemon Doward  was initially issued a summons for running the red light. However, he was arrested yesterday by the police and charged with second degree reckless endangerment, a top level misdemeanor that could send him in jail for a year.

Doward was delivering food at the time of the accident. Those who hire bicyclists for deliveries of their products need to provide safety instructions, appropriate supervision and insurance coverage in the event of negligence leading to injuries and deaths.

Our managing partner, Ben Rubinowitz is representing the family of Dona Sturm and the following statement was issued after her death on behalf of the family:  “Donna Sturm was a vibrant, energetic and wonderful woman who died as a result of carelessness and negligence. She died because a bicyclist completely disregarded the law. She was crossing a street, in the crosswalk, with the light in her favor when she was struck. Unfortunately, she suffered horrific head injuries and, although the doctors tried their best over the last week, they were unable to save her life,”

E-Cigarette-1After a 17 year old boy recently died from vaping in the Bronx, the city of New York announced that it filed a federal lawsuit against 22 online sellers of e-cigarettes who have been caught selling their products to underage clients. These sellers allegedly targeted young people through social media and advertising for flavored e-cigarettes such as “Lemon Twist,” “Freddy’s Pebbles” and “Whipped Salted Caramel”. They also accepted online purchases from teenagers.

According to the lawsuit that was filed yesterday in US District Court in Brooklyn, the defendants sold e-cigarettes to two New York City residents who were younger than 21 year old but older than 18 year old.  In order to purchase the e-cigarettes online, the two young New Yorkers created an email address and used prepaid Visa gift cards. Among the 22 sellers who accepted the orders some of them didn’t use age verification services or sold the e-cigarettes despite the buyers indicating that they were younger than 21.  The companies then shipped the orders to an address in New York City that was controlled by the New York City Sheriff’s Office. No signature or identification were required.

Last month an emergency ban of flavored e-cigarettes was voted by New York State officials (see previous blog) but last week a New York Court halted the ban one day before it was supposed to take effect after an industry trade group named Vapor Technology Association appealed the decision. The case will now be heard by the Supreme Court in Albany on October 18th. Until that date the ban can’t be applied.

The fatal accident occurred at a dangerous crossing intersection at about 74th Street on East Drive. 43 year old Charles Cheeseboro was riding a e-bike when he struck a 77 year old pedestrian, lost control of his bike and fell on the ground striking his head. He was transported to the hospital where he died from his injuries two days later.

Chaotic Situation

Adrian Benepe who was a Parks Commissioner under Mayor Blooomberg told Streetblog in a interview that Central Park had become so chaotic that he gave up cycling there. He described the actual situation in Central Park as the Wild, Wild West. The Daily News mentioned that when the police was investigating the accident they also had to respond to 3 other accidents that occurred less than 100 feet away. Among them, two cyclists crashed into each other and one of them was transported to the hospital. In another one, a cyclist fell off his bike after being allegedly on his phone while riding.

location-of-the-deadly-pick-up-truck-accidentA 67 year old pedestrian died from injuries sustained in a pick-up truck accident in New York.  On Saturday August 10th around 9.00 pm, Melissa McClure was in the crosswalk next to her sister at the corner of 15th Street and 6th Ave in Manhattan when a Chevrolet Silverado making a left turn slammed into them. Both women were transported to the hospital. The sister, 59 year old Dorry Chitwood who was visiting from Georgia, suffered a cut in the back of the head. She was treated at the hospital and released shortly after. Melissa sustained major head trauma during the accident.  After she arrived at the hospital, she was put on life support. She never woke up and died from her injuries almost a week later. Melissa who’s nickname was Missy, lived in Chelsea with her two cats. Her sister was visiting from Georgia. After her return flight was cancelled she decided to stay with her sister for an extra night. Both women were on their way for a dinner in Chinatown when the accident occured. The driver of the pick up truck stayed at the scene of the accident.

Dangerous Avenue

Busy 6th Avenue is dangerous for pedestrians and bicyclists alike. In June Robyn Hightman was riding her bike when she was fatally stuck by a truck near the intersection of 6th Ave and 23rd Street.  Then at the beginning of August another Chelsea resident, Michael Collopy, died after he was hit by a bicycle. Since January 2016, 18 pedestrians and 15 drivers were injured at this specific intersection.

craneAfter two successive crane accidents in New York including one fatal, the company United Crane and Rigging was temporary barred from continuing work at 22 construction sites in the city. The NYC DOB will allow the company to restart work only after it replaces some of the employees involved in the recent accidents that occurred on July 30 in the East Village and in April in Soho. On July 30, the company had a crane working at a site located at 749 FDR Drive. The operator of the crane was lifting steel beans when the boom of the crane bent and partially collapsed. The operator then lost control of the load which struck the building before falling on the ground. Thankfully nobody was injured but investigators found that the load lifted by the crane weighted 4,400 pounds while the maximum lifting capacity was 3,700 pounds. Back in April,  34 year old Gregory Echevarria, a war hero who served several deployments in Iraq and Afghanistan died and two other construction workers were injured after a counterweight fell and crushed him during a crane installation by the same operator (see previous blog).

To be able to restart work on its 22 construction sites, United Crane and Rigging has to provide proof to the NYC Department of Buildings that the engineer of record, master rigger, lift director, assembly and disassembly and hoisting machine operators have all been replaced with new staff. Additionally the company also has to hire an independent monitor who will report to the DOB on United Crane and Rigging’s safety compliance.The negligent crane company was also hit with 5 DOB violations for:

cyclist-nyc-e15620847726003 people died in bicycle accidents in NYC during the last 7 days.

Last Monday Robyn Hightman, a bike courier, was fatally struck by a truck on 6th Ave near 25th Street. Both the truck and the cyclist were heading in the same direction when they collided. The truck driver first didn’t stop but then returned to the scene of the accident after a witness in another car told him he hit someone. the driver told the police he didn’t know he hit the cyclist. Police said the driver was let go after he was hit with five summonses. The driver, 54 year old Antonio Garcia said it was the first time he had an accident since he started to work for his employer 14 years ago. However a look at the Howsmydrivingnyc.com indicates that the truck was hit with 83 violations since 2015 mostly for parking but also for speeding. A vigil was organized for Robyn during which hundreds of cyclists gathered and expressed not only their sadness but also their anger at authorities that are doing very little to hold drivers accountable. Robyn was the 12th cyclist in New York City to be killed in traffic this year.

Last Thursday night  around 9:00 pm, 57 year old Ernest Askew was fatally struck by an 18 year old driver on Sutter Avenue near Chester in Brownsville, Brooklyn. The car driver wasn’t arrested. Brownsville which is a low income community of color doesn’t have any protected bike lanes and there are not many efforts being made in regards to street safety. Cyclists share wide roadways with cars and speeding is common. At a vigil for Ernest Askew yesterday evening activists asked the city to address the lack of equity in low-income communities of color when it comes to protected bike lanes and street safety.

Location of the fatal pedestrian accident Little Italy New YorkA pedestrian was fatally struck by a taxi in New York on Saturday afternoon. The accident occurred on a busy and sunny Saturday afternoon in Little Italy, Downtown Manhattan. Around 4:00 pm a woman in her 80ies whose identity wasn’t revealed was crossing Broom Street in the crosswalk when a taxi making a left turn from Center onto Broom Street struck her. She was rushed to the hospital with severe personal injury. She was pronounced dead when she arrived there.

The cab driver, 44 Bouchouata Miloudi, stayed at the scene  of the accident. He was charged with failure to yield to a pedestrian and failure to use due care.

4 children and two adults died in a fire accident in New York early wednesday. The fire broke out a little after 1:30 am in the apartment where 45 year old Andrea Pollidore was living with her stepson 32 year old Matt Abdularauph and her 4 young children, 3 year old Elijah, 6 year old Brooklyn, 8 year old Andre and 11 year old Nakaira. Located on the fifth floor of the Frederick E. Samuel Houses at Adam Clayton Powell Jr. Blvd. and W. 142nd St, the 3 bedroom apartment was completely destroyed by the flames. The fire started from the kitchen burning stove that was left unattended. No fire alarm went on and the fire spread quickly to the entire apartment while the family was asleep. When they woke up it was too late. They were trapped in their rooms and couldn’t access the door or the fire escape anymore.  When the firefighters arrived flames were pouring out of five windows of the apartment.  When they reached the two rear rooms they found the six occupants dead.

This accident is one of the most deadly New York fire accidents. A candlelight vigil was held in front of the building. Mayor de Blasio was on the site as well and said the entire city was saddened by the tragedy. The family were beloved members of the community. According to friends and family, Pollidore was a wonderful single mother and a nurse who loved her children and would give her life for them.

NYCHA said a new smoke alarm was installed in the apartment in 2017 but the firefighters couldn’t find it and tenants testified that they didn’t hear any alarm. When the FDNY checked the apartments near the one that burned all of them had relatively new and working detectors. Investigators will have to find out why there were none recovered in the apartment.
