A fatal pedestrian collision in Flushing, Queens, involving a 1-year-old child raises significant legal issues concerning driver negligence, pedestrian right-of-way, impaired driving, and potential wrongful death liability under New York law.
According to the Queens District Attorney’s Office, the collision occurred on October 11, 2026, at the intersection of Murray Street and 32nd Avenue. Prosecutors allege that 57-year-old Elvin Rivera was operating a Chevrolet Silverado northbound on Murray Street when he failed to properly stop at a stop sign, entered the intersection, and struck a stroller carrying 1-year-old Justin Hu.
The child was transported to a hospital, where he was pronounced dead. His nanny, who was pushing the stroller, reportedly sustained an injury to her arm.
