SUV involved in the fatal hit and run accidentA pedestrian was killed in a hit and run accident in NYC on father’s day. Christopher Nieves, a 37 year old dad was struck by a brown 2004 Chevy Tahoe with a New York plate reading CRR 5224 and a sticker that says “Salt Life” on the rear window.  The police are now looking for the person who was behind the wheel of this SUV. The accident occurred a little bit after 6:00 am on father’s day. Christopher Nieves was trying to hail a cab when he was struck by the SUV speeding down the street. The driver never stopped. At the time of the accident, Christopher was with two friends who tried to pull him back when they saw the SUV but it was too late.

Nieves was rushed to the hospital but he couldn’t be saved.

A school bus driver who fatally hit a pedestrian back in February appeared in Bronx Criminal Court yesterday. On February 14th, 68 year old Agnes Egan was crossing the street at the intersection of Havemeyer Street and Story Avenue when she was struck by 66 year old Anton Goodhall who was driving a mini school bus south on Havemeyer. Video footage of the accident shows the minibus rolling over the pedestrian, stopping after the impact and then leaving the scene of the accident. Agnes Egan was critically injured and died 40 minutes later.

In Court the bus driver claimed he never saw the pedestrian. He said he stopped after the accident because he dropped a bottle of water. He also said that his visibility was reduced because two other cars were in  the intersection. He also mentioned a big pile of trash on a corner.

He is due to appear in Court again on July 11.

Staten Island Pedestrian killed in Brooklyn

65 year old Losif Morgenshteyn was fatally struck by a hit and run driver as he was changing a flat tire on the driver side of his car. The accident occurred on Saturday night around 6:30 pm. on Shore Parkway near East 28th Street in Sheepshead Bay. According to CBS News, the man was hit by a white Toyota minivan with Pennsylvania plates. 3 people came out of the van and checked on the condition of the pedestrian before speeding away. The van was found empty about a mile away and the police are still looking for the driver. When the EMS arrived they gave the man CPR and then rushed him to the hospital. Unfortunately he couldn’t be saved and he was pronounced dead upon his arrival.

Dusk and Darness Accident PreventionThe NYPD announced last week that A NYC pedestrian died from his injuries the day after an accident that occurred in the Bronx on November 7th around 6:30 pm.  52 year old Alvaro Gutierrez was crossing Southern  Boulevard at Elsmere Place when he was struck by a minivan.  Gutierrez who was hit in the crosswalk, flew in the air and landed on the roadway. He was transported to the hospital where he died the following day. The minivan driver wasn’t charged.

Winter is the worst season for pedestrians

Statistics show that, in New York, after daylight saving time ends, pedestrian accidents increase dramatically, especially during evening hours. The months of November to March are the deadliest for New York pedestrians. To boost awareness about this situation and encourage drivers to drive safely the city has been deploying its ‘Dusk And Darkness’ Vision Zero Safety Initiative for the third consecutive year.

Location of the garbage truck accident in BrooklynA private garbage truck struck and seriously injured a 78 year old woman who was crossing the street yesterday in New York City . The hauling truck that belongs to MIST Entreprise was making a left turn from East Fourth Street onto 18th Ave in Kensington, Brooklyn, when it hit the pedestrian. The accident occurred around 11:00 am. Witnesses saw the victim being pinned under the wheel of the truck. She was screaming and her leg was completely mangled.  The 78 year old woman was rushed to the hospital with serious injuries.  The driver of the truck stayed at the scene of the accident and so far hasn’t been charged.

KILLING MACHINES

The truck that crashed into the pedestrian has a history of reckless driving. According to city records, over the last two years, the truck was cited 5 times for running red lights.  Privater garbage truck haulers have a very bad reputation in New York City. Drivers are forced to drive long hours and cover large routes, making them prone to reckless driving.  Between 2010 and 2017, 43 New Yorkers died after being struck by private carting companies’garbage trucks. Organized labor believes that the Business Integrity Commission that regulates them is not doing enough to prevent this carnage. Not even a month ago another elderly resident from the Bronx was fatally struck by a private garbage truck. Police investigated the accident and discovered that the driver had previously fatally ran over a colleague with his truck 6 months before. He lied to the police about it and was still allowed to drive without being charged. (see previous blog).

In a previous post we mentioned that a pedestrian was fatally struck by a garbage truck belonging to Sanitation Salvage two weeks ago in the Bronx. Leon Clark, a man in his 70ies who was living in Adams Houses was walking on E. 152nd St. near Jackson Ave in Morrisiana when he was fatally struck by a private garbage truck driven by 33 year old Sean Spence. It is the second time in less than 6 months that Spence killed a pedestrian while driving his truck.

On November 7, Spence was driving his truck when he fatally ran over 21 year old Mouctar Diallo, an off-the books employee who was helping him. Diallo was standing on the the steps leading to the passenger’s door when he lost  his grip,  fell under the truck’s rear wheels and died. Spence initially lied to the police and claimed that the victim was a crazy homeless man who tried to jumped on the side of his truck.

A young pedestrian died after being struck by a van on a Bronx sidewalk in New York City. 8 year old Cellou Diallo was part of a group of children that just came out of a van  that had parked on East 125th Street in Williamsbridge . As they were on the sidewalk with the driver, one of the kids noticed that one of the van’s wheels was on the curb. The driver asked the kids to wait on the sidewalk while she got back in the car and tried to proprely park. As she was maneuvering, she lost control of the vehicle while backing up and pinned 8 year old Cellou Diallo against the wall of the adjacent building. She got out of the vehicle screaming  “I killed a mother’s baby, I killed someone’s baby.”She was devastated and crying. The other children were horrified. The woman was a close friend and neighbors of Cellou’s parents. The two families would take turns driving the kids to after school programs. Cellou Diallo came from the same family as Amadou Diallo who was wrongfully killed by the NYPD.  epilepsyA New York taxi driver who fatally struck two pedestrians in the Bronx after he stopped taking his epilepsy medication pled guilty to one count of assault, a class D felony, and two counts of homicide. On March 20 2015, Emilio Garcia who had been off his epilepsy medications for 3 months, lost control of his taxi and fatally struck 5 year old Tierre Clark and 25 year old Kadeem Brown on the Grand Concourse near 170th Street in the Bronx. Several pedestrians were also injured during the crash. The accident occurred 3 months after a previous collision during which Garcia injured another driver in New York City. Drivers who, like Garcia, are affected by a medical condition that can affect driving, such as epilepsy, are supposed to report their condition to the New York State Department of Motor Vehicles. Garcia never disclosed his condition. Not even at the time of the first accident. He just continued to drive despite knowing that his negligent behavior was putting road users at risks of dangerous accidents. The Taxi and Limousine Commission also failed to prevent Garcia from continuing to drive after the first accident. The taxi driver is expected to be sentenced in December.

Epilepsy is a serious condition that can be treated. Anyone suffering from this condition and driving a vehicle has to be medicated. Unfortunately Garcia is not the first driver who got off his meds and ended up killing pedestrians in New York City.  In 2015 in the Bronx,  a man who didn’t take his medications had a seizure behind the wheel and killed a 10 year old girl, her grand father and another man. He was charged with manslaughter.  In 2008 a garbage truck driver who was off his meds killed two people after loosing control of his truck. He was convicted of murder.

location of Bronx fatal truck accident

A pedestrian was fatally hit by a box truck in New York City yesterday morning. The 60 year old man was crossing the intersection of Webster Avenue and East 193rd Street around 7:12 am when he was struck by a box truck. According to the police, the truck driver was waiting for the light at the intersection. When the light turned green he accelerated and fatally hit the pedestrian. He remained at the scene of the accident and wasn’t arrested. The pedestrian died at the scene of the accident. The police are still investigating.

The intersection is very large and very dangerous with a history of accidents. According to the Vision Zero map, since 2009, 6 pedestrians, 3 cyclists and 26 motorists were injured in accidents at this spot.  In 2009, 1 pedestrian, 1 cyclists and 4 motorists were injured in accidents at this location. In 2010, another pedestrian was injured. In 2011, 9 motorists, 1 cyclist and 2 pedestrians suffered personal injury at this dangerous intersection. In 2012, again 2 pedestrians, 1 cyclist and 2 motorists were injured. In 2014, 2 motorists were injured. Another motorist and a pedestrian were injured in 2015. Last year an additional pedestrian was hurt as well as 3 motorists. So far this year 5 motorists were injured in crashes at this particular location.

6 people were injured including 3 seriously in a car accident in Staten Island, NYC on Sunday. A 74 year old driver who was backing out of a parking spot in front of a laundromat, hit the gas instead of the brake and reared back at full speed in the busy laundromat. The storefront was completely destroyed and damages are estimated to be above $20,000. 8 customers were inside the laundromat at the time of the accident. 6 of them were hurt including a pregnant woman who complained she couldn’t feel her legs anymore. She was in a lot of pain according to witnesses. Some of the customers were directly hit by the car and others by the folding tables that came crashing against the washing machines and dryers. The accident was extremely scary.  According to the owner of the laundromat it is not the first time that a car crashed into the storefront. Another car crashed into the laundromat last year according to the owner. See video of the accident below and read more in the Gothamist
