imageA drunk off duty cop killed a pedestrian and injured 3 others in Brooklyn, NYC, Sunday around 3:00 am.  21 year old Andrew Esquivel (photo ), a MIT student interning in New York for the summer , was walking home when he was hit by an out of control car that jumped the curb. Another man and two other women were seriously injured in the accident. The driver of the car was off duty NYPD Officer Nicholas Batka who was allegedly drunk but refused a breathalyzer test. He was charged with vehicular manslaughter, three counts of assault, driving while intoxicated, driving with impaired ability and driving on a sidewalk. Read more in the NY Daily News

steel plateThree construction workers suffered serious personal injury on a construction site in Brooklyn. The three hard hats were working on a building located on 21st Street near the Gownaus expressway. A steel plate came loose and struck the three workers. They were all transported to the hospital in serious condition.

Steel plates are commonly used in construction sites to reinforce structures. Construction accidents related to loose steel plates are unfortunately happening too often. Due to the heavy weight of the steel plate, they can result in serious personal injury or death. Workers and supervisors always should make sure that steel plates are proprely secured to prevent this type of construction accident.

Heather29 year old Heather Lough died from critical injuries sustained after she was struck by a truck while riding her bike in Brooklyn, NYC. The young woman had just been hired to work at the Brooklyn Botanical Gardens and was on her way to work when the accident happened.  Heater was coming out of the Metro North station and was riding her bicycle on Southern Boulevard when she was hit by a truck making a left turn at high speed. The bicyclist got stuck under the wheels and she was dragged for some distance under the truck until the driver stopped.  She was taken to the hospital in critical condition where she died from her injuries after five days of pain and suffering. The truck driver, 45 year old Robert Owens from Upper Manhattan was charged with reckless driving and failure to yield.

A motorist was severely injured by a bicyclist who hit him in the head with his bike lock in a road rage incident in Brooklyn NYC.  Around 7:30 pm on Monday night, a 59 year old man had just left a Greenpoint gas station and was driving his car on McGuinness Boulevard between Meeker Avenue and Bayard Street when he got into a conflict with a bike rider. The bicyclist accused him of almost hitting him. He then took his bike lock and started to smash it on the car, He then opened the car’s door, pulled out the driver and repeatedly hit the man on the head.  Then he fled. The police are still looking for him. The driver was transported to the hospital and treated for head injuries and cuts to his hands. Incidents of road rage are reaching epidemic proportions. It is a sign of increasing stress especially in N.Y.C. The perpetrators should be subject to Felony charges and sentenced to jail time.

A pedestrian died and two other people were injured in a car accident in NYC on Sunday. The accident occurred at the intersection of E. 94th Street and Avenue K in Canarsie, Brooklyn. The driver of a SUV struck another car, lost control of the vehicle that slammed into two pedestrians waiting to cross the road. The pedestrians were a couple living nearby. The wife, 51 year old, Chooi Tan  suffered severe injury. The couple as well as the driver of the car hit by the SUV were all transported to the hospital. Chooi Tan died at the hospital while her husband and the driver were in stable condition.

The driver of the SUV and a passenger fled the scene of the accident by foot. The police are still looking for them. The SUV was reported stolen last Friday.

Several bicyclists were injured in an accident with a motorcycle in Brooklyn, NYC. The bicyclists were all participating in the the popular Red Hook Criterium 30k bike race in Brooklyn. The motorcyclist who was supposed to ride ahead of the race stalled near the start of the men’s final race. A bicyclist struck the motorcyclist and then a second one obstructing the narrow passage which competitors were riding through, resulting in a massive pile-up of dozens of bicyclists (see video). Seven bike riders were taken to the hospital to be treated for non- life threatening injuries. The men’s final was restarted shortly after the accident.

KingsbrookA hard hat worker suffered critical injury in a NYC construction accident yesterday. A construction truck hit a suspended cable line causing a pole to fall, knocking down the construction worker into a 15 foot trench. The accident happened at the corner of East 49th Street and Rutland Road in Brownsville, next to the Kingsbrook Jewish Medical Center.

When Brian Yokers, one the ER doctors at the Kingsbrook Jewish Medical Center, heard about a worker in cardiac arrest at the construction site next to the hospital he ran out to the construction site and followed the crowd to the trench. The worker was still breathing when he arrived. He stepped down the ladder into the trench to help the worker.  He held his head stable to prevent a spinal cord injury until the FDNY arrived with a neck brace. The worker was then placed on a backboard and hoisted out of the trench. He was then transported to the Kings County Hospital.

NYC fire12 people were injured in a fire in New York City Tuesday night. 4 of the victims were transported to the hospital. One of them suffered serious injuries. The other victims were treated on location for smoke inhalation and other minor injuries.

According to the NY Daily News, the fire started on a building rooftop around 10:00 pm on Dekalb Ave between Knickerbocker Ave and Wilson Ave and spread to four other rooftops. Families who lived in the building were able to escape the building  with the help of two early responding police officers. The firefighters who arrived shortly after searched every floor for potential victims.  A resident told the NY Daily News that his smoke alarm never went off and that the screams from other building residents alerted him to get out.

According to the FDNY commissioner, Daniel Nigro, an extension built behind one of the buildings partially collapsed and triggered the fire to quickly spread to the other buildings. By midnight one of the building’s front facades had collapsed. Several apartments were damaged during the fire leaving 90 people homeless.

Fire escapeA 23 year old man suffered critical injury after he stepped on a defective fire escape and fell 4 stories to the ground. 23 year old Chad Miller was about to move to a new apartment on Bedford Ave near Lefferts Boulevard in Brooklyn, NYC. He was hanging out with a friend on the fire escape outside his new place when the railing broke. Chad fell 4 stories and was critically injured. According to his dad, his son is still in a coma.

The owner of the building  received a violation for failure to maintain the fire escape. It could cost him up to a $5000 penalty. There is also a good chance that the family of the victim files a premises liability lawsuit against him. In 2011 we settled a case for $5,000,000.00 when a fire escape landing on which a man was standing on collapsed causing him to fall approximately 30 feet to the ground. Discussion of case here.

A pedestrian suffered serious injury after being hit by a car in New York City but according to a witness, the driver was let go by the police after he flashed a badge.

On January 11th, 63 year old  Cindy Klump who managed the drawing Center at Pratt Institute, was trying to cross Myrtle Ave at Ryerson Street in Brooklyn, NYC.  As she was crossing, she tripped and fell on the ground. She was getting back when up she was hit in the back by a a light colored minivan.  John Cisneros, a Pratt student who witnessed the accident saw the van driver parking his vehicle 50 feet away and run to rescue the woman. Another woman who also witnessed the accident ran to the rescue. She had medical training and tended to Klump while Cisneros called 911.

The ambulance and the police showed up shortly after. One of the police officers, Officer Orlando Vargas, started to interview the woman who helped Klump. She pointed at the driver who was still around and pointed at his car and told the officer: “that’s the guy who hit her and that’s his car”. The driver denied it and said it was a car before him who struck the woman and ran away. Cisneros said he saw the driver flashing a badge to Officer Vargas. He then kept the badge on a chain around his neck and was let go by Officer Vargas.
